India has strong legislation protecting citizens from air pollution. Know which laws apply — and how to use them to hold polluters accountable in Pune.
Prohibits emission of air pollutants beyond prescribed standards from any industry, vehicle, or generator. Violations can be reported to MPCB (Maharashtra Pollution Control Board).
Construction sites above 20,000 sqm must install anti-smog guns, cover material stockpiles, and prevent dust escape. PMC/PCMC can penalise non-compliant sites.
The National Green Tribunal has repeatedly banned open burning of waste, garbage (kachra), crop residue, and tyres in urban areas. Violations are cognisable offences.
Vehicles emitting smoke beyond Bharat Stage norms can be challaned by traffic police. Diesel generators must comply with CPCB emission standards.
Industries must obtain Consent to Operate from MPCB and stay within emission limits. Citizens can file complaints with MPCB if limits are exceeded.
Fogging operations must use approved pesticides at prescribed concentrations and provide advance notice to residents. Unauthorised or excessive fogging is a violation.
Pune Municipal Corporation now mandates sensor-based real-time PM2.5/PM10 monitoring plus a public LED dust-severity board at all construction & infrastructure projects of 5,000 sq m or more (tightening toward 1,000 sq m). Non-compliance invites show-cause notices, stop-work orders and penalties.

Under a circular dated 15 December 2025, the Pune Municipal Corporation requires every construction & infrastructure project of 5,000 sq m or more (tightening toward 1,000 sq m) to run a real-time PM2.5/PM10 monitor and display a public LED "dust-severity" board. The colour on that board tells you — and the site — exactly when dust is dangerous:
Normal. Routine dust control (nets, sprinklers).
Increase sprinkling; check dust sources.
Intensify suppression; slow dusty work.
Stop dust-generating work immediately.

If you have witnessed air pollution from a construction site, industrial unit, open burning, or illegal fumigation, you can file a complaint. Here's how:
Document the violation — use MyAQI.org to record the AQI spike with timestamp and GPS coordinates.
Identify the applicable law from the list above. Note the section number — you will need it in your complaint.
Find your local enforcement agency below (MPCB, PMC, Police, or NGT) and file online or in person.
